Prenuptial agreement validity stands up in court

On behalf of Stange Law Firm, PC posted in Property Division on Thursday, November 1, 2012.

A prenuptial agreement is one way to handle property division. Granted, many might not find it the most romantic to negotiate a prenuptial agreement before a marriage, but doing this ahead of time does ensure that in the case of a divorce — especially a high-asset divorce — property would be properly divided.

Deion Sanders, who was a former cornerback for the Cowboys and other NFL teams, did the right thing by negotiating a prenuptial agreement 14 years ago when he married model Pilar Sanders. At the time, he most likely believed the marriage would be forever, however, he was still careful enough to make sure there was an agreement in place should there ever be a divorce.

Turns out, it’s a good thing he did too, as the couple — just like many other Illinois couples — is going through a rather contentious divorce right now. One of the main points of bitterness is the prenuptial agreement. His estranged wife claimed she was pressured into signing the agreement and that part of the prenuptial agreement was forged.

However, a judge overseeing the case disagreed with her claim, pointing out that she voluntarily signed the agreement. She is now no longer allowed to bring that forced claim into court.

With the prenuptial agreement, it’s not like Pilar Sanders is left with nothing either. Rather, by the agreement, she will get $1 million once the divorce is finalized. Just for signing the agreement she also received $100,000.

In terms of child support, Pilar Sanders claims Deion Sanders is not paying the $10,500 a month that was ordered by the court. According to Deion Sanders, this is due to the fact that more than $10,000 a month for child support is way too high. Rather, he is paying the maximum that is allowed by the state.

Overall, he claims the real issue is that hi soon-to-be ex-wife is realizing that her lifestyle is no longer going to be the same as it once was and she is acting out of greed. Whether this is true or not, one thing that cannot be disputed is that it’s a good thing Deion Sanders thought about the situation ahead of time and had a prenuptial agreement before saying “I do.”
