Why now is the best time to plan a divorce

As part of the planning process, it may be a good idea to negotiate the terms of a future divorce. While it may seem odd to create a divorce settlement during what should be a happy time, it can make things easier if a marriage eventually fails. Agreements can be created either before or after the wedding takes place.

If a divorce pact is reached before the wedding, it will be referred to as a prenuptial agreement. The term for creating a marriage contract after a wedding is a postnuptial agreement. Both types of contracts allow parents to determine what property a person gets to keep and what items could be sold. It is also possible to come to terms on the amount of spousal support each person could receive.

In some cases, parents will create parenting plans on their own, but it is important to note that these plans may not be approved by a judge. When making a visitation or custody ruling, a judge will look to see what is in the best interests of the child. It may be best to check with an attorney ahead of time to determine what can and cannot be included in a custom marriage contract.

The end of a marriage may be easier to handle if there is a plan for dividing debts and assets. A prenuptial or postnuptial agreement may allow couples to come to an understanding while they are on good terms with other or are otherwise willing to work together. An attorney may be able to review such an agreement during a divorce proceeding.
